User generated content policy
1. Introduction
Welcome to Pollarize By using our platform, you agree to these Terms and Conditions for User-Generated Content ("Terms"). These Terms govern your interaction with features allowing you to create, upload, and share content ("User-Generated Content" or "UGC") on our platform. Please ensure you read these Terms carefully.
2. Acceptance of Terms
Before submitting UGC, you need to confirm that you understand and agree to comply with these Terms. If you do not agree, you will not be able to use any UGC features of our app.
3. Prohibited Content
You are strictly prohibited from creating, uploading, or sharing content that:
- Violates applicable laws or regulations.
- Contains harmful or abusive material, including hate speech, harassment, or explicit content.
- Infringes upon intellectual property rights, such as copyright or trademarks.
- Promotes illegal activities or includes malicious software.
- Discloses private or sensitive personal information without authorization.
4. Ownership and License
By uploading UGC, you retain ownership of the content. However, you grant Pollarize a non-exclusive, worldwide, royalty-free license to use, display, reproduce, adapt, and distribute your content for purposes directly related to operating or marketing the app.
5. Copyright Protection
If you believe your content has been infringed upon, please notify us immediately. We will take reasonable steps to address copyright issues and remove infringing content.
6. Limitation of Liability
To the fullest extent permitted by applicable law:
- Pollarize and all its related parties shall not be liable for any indirect, special, incidental, punitive, exemplary, or consequential damages, including but not limited to loss of use, data, business, or profits, arising out of or in connection with the use of or inability to use the services, devices, third-party applications, or third-party content, regardless of the legal theory and even if Pollarize has been advised of the possibility of such damages.
- Your sole and exclusive remedy for any issues or dissatisfaction with Pollarize's services is to discontinue use of the services and uninstall any related applications.
- Pollarize has no liability or obligation related to third-party applications or their content made available in connection with our services. Your sole and exclusive remedy for issues with third-party applications is to uninstall or stop using them.
- Aggregate liability for all claims relating to the services, third-party applications, or content shall not exceed the greater of (a) the amount you have paid to Pollarize in the twelve months prior to the claim, or (b) €10.
- These limitations are fundamental to the agreement between you and Pollarize, and the services would not be provided without them.
For clarity, these Terms do not exclude liability for fraud, fraudulent misrepresentation, or any injury or death where such liability cannot legally be excluded.
Any claims arising under these Terms must be commenced within one (1) year of the date you first became aware of the act, omission, or default giving rise to the claim. Claims not brought within this period will be deemed permanently waived.
7. Acceptable Use
All users are required to adhere to acceptable use guidelines:
- UGC must be respectful and appropriate.
- Abusive, illegal, or harmful uses are prohibited.
Failure to comply may result in account suspension or termination.
8. Child Sexual Abuse Material (CSAM)
We have a zero-tolerance policy toward any form of Child Sexual Abuse Material (CSAM). Any content that depicts, promotes, solicits, or facilitates child exploitation—including images, videos, text, or any other material—is strictly prohibited.
Our platform actively monitors, detects, and reports CSAM in compliance with applicable laws and global child protection efforts. Any user found engaging in the creation, sharing, or distribution of CSAM will face immediate account termination, and such material will be reported to law enforcement and child protection authorities.
We are committed to working with industry partners, authorities, and technology solutions to prevent the spread of CSAM and to protect vulnerable individuals. 9. Reporting and Moderation
Users can report inappropriate content via the in-app reporting system. We reserve the right to remove UGC that violates these Terms and take action against accounts responsible for such content.
10. Termination of Access
We reserve the right to terminate or restrict your access to UGC features at our sole discretion if these Terms are violated.
11. Changes to Terms
We may make changes to this Policy.
When changes are made to this policy, we will notify you within the app. You will be required to accept the changes in order to keep using the app. Since policy documents can be quite extensive, we will try to break the changes down into easy-to-read sections so you actually know what you are agreeing to.

13. Intellectual Property Policy
13.1 Respect for Intellectual Property
Pollarize respects intellectual property rights and expects its users to do the same. By using our platform, you agree to adhere to these Terms, all applicable laws, and respect the intellectual property, privacy, and other rights of third parties.
13.2 Copyright
Copyright is a legal protection for original works of authorship, such as music, artwork, and written content. Copyright grants the owner exclusive rights to use, distribute, and display their work. You may not upload, share, or otherwise distribute copyrighted content on our platform without proper authorization.
If you believe that your copyrighted work has been infringed upon via our services, you may submit a notice of alleged copyright infringement. Your notice must include:
- Identification of the copyrighted work believed to be infringed.
- A description of where the allegedly infringing material is located (e.g., a URL).
- Contact details, including your full name, address, phone number, and email.
- A statement asserting that you have a good faith belief that the use is not authorized.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
- Your physical or electronic signature.
Notices may be sent to our designated copyright agent at contact@poll-arize.com. Fraudulent claims or misuse of this process may result in legal consequences or account termination.
13.3 Trademark
Trademarks, such as brand names or logos, distinguish products and services and help prevent consumer confusion. Users must not upload or share content that infringes on the trademark rights of others.
Trademark owners who believe their rights are being infringed can report the issue by submitting a notice of alleged infringement to contact@poll-arize.com.
13.4 Handling Intellectual Property Claims
Pollarize reviews claims of intellectual property infringement submitted through the designated channels. Upon review, we may take actions such as removing reported content or restricting access. In cases of multiple or repeated violations, user accounts may be suspended or terminated in accordance with our policies.
If content is removed due to an intellectual property claim and you believe this was done in error, you may submit an appeal. Instructions for submitting an appeal will be included in the communication regarding the action taken.
13.5 Repeat Infringer Policy
We maintain a policy to terminate accounts associated with multiple violations of intellectual property rights. However, if claims are retracted or appeals are successful, our records will reflect these updates accordingly.
14. Prohibited Content and Behaviors
Pollarize is committed to providing a safe and respectful environment for all users. As part of our policies, we prohibit content and behaviors that are considered objectionable, as defined below, in compliance with Google Play Developer Program Policies.
14.1 Objectionable Content
Users are strictly prohibited from submitting, sharing, or engaging in content or actions that include:
- Hate speech or discrimination based on race, ethnicity, nationality, religion, gender, sexual orientation, or disability.
- Harassment, bullying, threats, or incitement to violence.
- Graphic depictions of violence, gore, or explicit sexual content.
- False or misleading information, including scams, impersonation, or fraud.
- Malicious software, viruses, or content that disrupts the app’s functionality.
- Promotion or facilitation of illegal activities, such as drug use, gambling, or hacking.
- Content that infringes on the intellectual property rights of others.
14.2 Enforcement and Reporting
We reserve the right to review, moderate, and remove objectionable content or behaviors that violate these Terms. Users are encouraged to report any violations through our in-app reporting system. Violators may face actions such as content removal, account suspension, or termination.
14.3 Compliance with Policies
All users agree to comply with these Terms and applicable laws, as well as the guidelines set forth by Google Play Developer Program Policies. Failure to adhere may result in suspension or removal from the platform.
